Formix (Pvt) Ltd operates as an enterprise-grade recruitment and HR solutions company serving organisations across Sri Lanka, Maldives, Bangladesh, Australia, and global markets. Every service engagement entered into by Formix is governed by a formal, legally binding service agreement that clearly defines the scope of work, deliverables, timelines, payment terms, confidentiality obligations, and all other terms and conditions applicable to that specific engagement.
No Formix service commences without a signed service agreement in place between Formix and the client organisation. This ensures complete clarity and transparency for both parties from the outset of every engagement protecting the interests of our clients, our candidates, and our organisation throughout the delivery of our services.
Service agreements issued by Formix are tailored to the specific nature of each engagement. The structure, terms, and conditions of a service agreement will vary depending on the type of service being provided, the markets in which the service is being delivered, the duration and scope of the engagement, and any specific requirements agreed between Formix and the client organisation.
As a result, no two Formix service agreements are identical. A recruitment and headhunting agreement will differ in structure and terms from a payroll administration agreement, an employer of record engagement, an HR outsourcing arrangement, or a training and development programme. Each agreement is drafted to accurately reflect the specific service being delivered and the commercial terms agreed between the parties.
Clients are encouraged to review their service agreement carefully before signing and to raise any questions or concerns with their dedicated Formix consultant prior to commencement. Formix is committed to ensuring that every client fully understands the terms of their engagement before work begins.
All service agreements issued by Formix are legally binding documents. By signing a Formix service agreement, the client organisation confirms their acceptance of all terms and conditions contained within that agreement and their commitment to fulfilling their obligations as outlined therein. Formix equally commits to fulfilling its obligations as defined in the agreement, delivering services to the standard and within the timelines agreed.
Service agreements are enforceable in accordance with applicable law and represent the entire agreement between Formix and the client organisation with respect to the specific engagement. No verbal representations, prior communications, or informal understandings constitute a binding commitment on the part of either party unless expressly incorporated into the signed service agreement.
Any amendments to a service agreement must be agreed in writing by both parties. Verbal amendments or informal changes to agreed terms are not recognised as binding modifications to any Formix service agreement.
All Formix service agreements include confidentiality provisions that protect the interests of both parties. Client organisations agree to treat all candidate information, talent pool data, proprietary methodologies, pricing, and other confidential information shared by Formix with strict confidentiality. Formix equally commits to protecting all confidential information belonging to client organisations that is shared in the course of delivering our services.
Confidentiality obligations under Formix service agreements survive the termination or expiry of the engagement and remain in effect for the period specified in the relevant agreement.
Service agreements may be terminated by either party in accordance with the termination provisions contained within the specific agreement. Termination terms vary by service type and engagement scope and will be clearly defined in your agreement. Where a client organisation terminates an engagement prior to completion, payment obligations for work already delivered or commenced may still apply in accordance with the terms of the agreement.
Formix reserves the right to terminate any service agreement immediately and without notice where a client organisation has breached the terms of the agreement, engaged in unlawful conduct, or acted in a manner that is harmful to Formix, our candidates, or any third party.
In the event of any dispute arising in connection with a Formix service agreement, both parties agree to first attempt to resolve the matter through direct and good-faith negotiation. Formix is committed to addressing any concerns raised by client organisations promptly and professionally. Where a dispute cannot be resolved through negotiation, the parties may seek resolution through mediation or other appropriate legal mechanisms as specified in the relevant service agreement.
